For orders of the DESIGNLOVR Collection by consumers and entrepreneurs, these General Terms and Conditions (GTC) apply.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity, which acts in exercise of its commercial or independent professional activity when concluding a legal transaction.
The following applies to entrepreneurs: If the entrepreneur uses conflicting or supplementary General Terms and Conditions of Business (GTC), their validity is hereby objected to; they only become part of the contract if we have expressly agreed to them.
2. Conclusion of contract
The purchase contract is concluded with DESIGNLOVR, Kim-Christopher Granz, Ovelgönnerstr. 12, 21755 Hechthausen, Germany.
By placing the DESIGNLOVR Collection in our online store, we make a binding offer to conclude a contract for these products. The consumer can initially place our products in the shopping cart without obligation and correct the entries at any time before sending the binding order by using the correction aids provided and explained in the order process.
The contract is concluded when the consumer, by clicking the order button, accepts the offer for the goods contained in the shopping cart and accepts these contractual terms and conditions. Immediately after sending the order, the consumer receives another confirmation by e-mail.
In the e-mail, the consumer’s order is listed once again so that the consumer can print the order using the “Print” function. It should be noted that the delivery of the ordered products will take place as soon as the payment of the full purchase price and any shipping costs have been received.
The German language is available for the conclusion of the contract.
3. Terms of delivery
In addition to the indicated product prices, shipping costs may be incurred. The consumer will be informed of more detailed provisions on any shipping costs that may be incurred in the offers.
DESIGNLOVR generally delivers by mail. A self-collection of the goods is only possible after contacting us. DESIGNLOVR does not deliver to packing stations.
4. Terms of payment
The prices listed in our online store at the time of the order are valid. The prices of the DESIGNLOVR Collection are quoted inclusive of the applicable statutory value-added tax.
For payment, the consumer can only use the payment methods agreed and specified when ordering. Payment is due immediately upon the conclusion of the contract. The goods shall remain the property of DESIGNLOVR until the purchase price has been paid in full.
The consumer agrees to receive invoices and credit notes exclusively in electronic form.
5. Right of withdrawal
Consumers are entitled to the legal right of revocation as described in the cancelation policy. Entrepreneurs are not granted a voluntary right of revocation.
In the event of a revocation, the consumer must bear the direct costs of the return shipment.
6. Damage in transit
If goods with obvious transport damages are delivered, we at DESIGNLOVR ask the consumer to immediately notify the deliverer of such defects. Furthermore we ask for immediate contact.
Failure to make a complaint or contact us will not have any consequences for the legal claims of the consumer and their enforcement, especially the warranty rights.
However, the consumer helps us to be able to assert our own claims against the carrier or the transport insurance company.
7. Warranty and guarantees
The statutory warranty suggestions apply.
The consumer will find information on any additional warranties and their exact conditions in the description of the respective product.
By purchasing a voucher or using it, the consumer accepts these general terms and conditions (GTC). In the case of DESIGNLOVR Collection, a voucher can only be purchased and redeemed in the designated area of our online store.
When ordering a voucher, the consumer is obliged to provide a correct address for delivery of the voucher and/or a valid e-mail address for sending the voucher code.
The voucher can be used to pay the total or partial value of the shopping cart. If the credit balance of the voucher is not sufficient for the order, the consumer can pay the difference with one of the offered payment methods.
The consumer can only redeem the voucher before the completion of the order process. The credit balance will neither be paid out in cash nor will interest be paid. If the consumer uses a voucher as a means of payment, it is not possible to use a discount code for the order. Only one voucher can be redeemed per order.
The voucher is valid for three years from the date of purchase. After the expiration of the validity period, the voucher cannot be used for purchases, nor will the remaining value be refunded. Within the validity period, the consumer can use the voucher until the voucher’s credit is zero.
Coupons cannot be exchanged.
9. Settlement of disputes
The EU Commission provides a platform for online dispute resolution on the Internet under the following link: https://ec.europa.eu/consumers/odr. This platform serves as a contact point for out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved.
DESIGNLOVR is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
10. Final provisions
For entrepreneurs, German law applies under exclusion of the UN-purchase law.
