When is data collected?

DESIGNLOVR collects data, for example, if a user informs us of this in an e-mail. This may be the data contained in the user's e-mail signature, for example.

Furthermore, data is automatically collected by the IT systems we use when you visit the DESIGNLOVR website. These are mainly technical data (e.g. the browser used and its version, the operating system or the time of the page visit). If DESIGNLOVR entrusts third parties with the processing of data on the basis of a so-called "order processing contract", this is done on the basis of Art. 28 DS-GMO.

Cooperation with contract processors and third parties

Transfer to third countries

If DESIGNLOVR processes data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if this occurs in the context of the use of third-party services or disclosure or transfer of data to third parties, this only takes place if it occurs for the fulfillment of our (pre)contractual obligations, on the basis of the consent, on the basis of a legal obligation or on the basis of our legitimate interests.

Subject to legal or contractual permissions, DESIGNLOVR will only process or leave the data in a third country if the special requirements of Art. 44 ff. GDPR processing. This means, for example, processing is carried out on the basis of special guarantees, such as the officially recognised determination of a level of data protection corresponding to the EU (e.g. for the USA by the “Privacy Shield”) or compliance with officially recognised special contractual obligations (so-called “Standard Contractual Clauses”).

Deletion of data

The data stored by DESIGNLOVR will be deleted as soon as it is no longer required for its intended purpose and there are no legal storage obligations to prevent deletion. If the data are not deleted by the user because they are necessary for other and legally permissible purposes, their processing is restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax reasons.

In accordance with statutory requirements, the records are kept for 6 years in accordance with § 257 (1) HGB (trading books, inventories, opening balance sheets, annual financial statements, commercial letters, accounting documents, etc.) and for 10 years in accordance with § 147 (1) AO (books, records, management reports, accounting documents, commercial and business letters, documents relevant for taxation, etc.).

3. Rights Of The User Concerned

The user has the right to request confirmation as to whether the data concerned are being processed and to request information about these data as well as further information and a copy of the data in accordance with Art. 15 GDPR.

The user has correspondingly. Article 16 of the GDPR gives the right to request the completion of the data concerned or the correction of the incorrect data concerned.

In accordance with Art. 17 GDPR, the user has the right to demand that the relevant data be deleted immediately or, alternatively, to demand a restriction on the processing of the data in accordance with Art. 18 GDPR.

The user has the right to request that the relevant data provided to us be received in accordance with Art. 20 GDPR and to demand their transmission to other persons responsible.

Furthermore, the user has the right to file a complaint with the competent supervisory authority pursuant to Art. 77 GDPR.

Right of revocation

The user of the DESIGNLOVR website has the right to revoke consents granted pursuant to Art. 7 paras. 3 GDPR with effect for the future.

Right of objection

The user of the DESIGNLOVR website can object to the future processing of the relevant data in accordance with Art. 21 GDPR at any time. The objection may be lodged in particular against processing for direct marketing purposes.

4. Data Collection On This Website

Cookies

“Cookies” are small files that are stored on the user's device. Different data can be stored within the cookies. A cookie is primarily used to indicate the user (or the device on which the cookie is stored) during or after visiting the DESIGNLOVR website.

Hosting and server log files

The hosting used by DESIGNLOVR serves to provide the following services: Infrastructure and platform services, computing capacity, storage and database services, e-mail delivery, security services and technical maintenance used by DESIGNLOVR to operate the Site.

DESIGNLOVR has chosen ALL-INKL.COM - Neue Medien Münnich, Hauptstraße 68, 02742 Friedersdorf, Germany as its service provider. The service provider's data center is located in Dresden, so that all data is stored exclusively in Germany. For the processing of the stored data we have concluded a contract for order data processing. Further information and the applicable data protection regulations can be accessed by the user at https://all-inkl.com/datenschutz/.

Furthermore, DESIGNLOVR would like to point out to its user that our service provider, on the basis of the legitimate interest within the meaning of Art. 6 para. 1 lit. f. GDPR data on each access to the server on which this website is located (so-called server log files). The so-called access data includes, among other things, the name of the accessed website, file, date and time of access, transferred data volume, notification of successful access, browser type and version, operating system, referrer URL (the previously visited website), IP address and the requesting provider.

The log file information is stored for a maximum of 7 days for security reasons (e.g. to investigate misuse or fraud) and then deleted. Data whose further storage is required for evidentiary purposes are excluded from deletion until the respective incident has been finally clarified.

Contact us by e-mail or contact form

When contacting DESIGNLOVR (e.g. via contact form, e-mail, telephone or social media), the data provided by the user for processing the contact enquiry and its processing pursuant to Art. 6 para. 1 lit. b. (in the context of contractual/pre-contractual relationships), Art. 6 para. 1 lit. f. (other requests) GDPR processed. The information could be stored, for example, in a customer relationship management system (in short: “CRM system”) or a comparable request organization.

Following a request from the user, DESIGNLOVR will delete the data again if this is no longer necessary. DESIGNLOVR checks the necessity every two years; furthermore, the legal archiving obligations apply.

Using the DISQUS comment function

DESIGNLOVR provides an efficient, secure and user-friendly comment management based on justified interest in accordance with Art. 6 para. 1 lit. f. GDPR, the commentary service DISQUS, offered by DISQUS, Inc. 301 Howard St, Floor 3 San Francisco, California- 94105, USA. DISQUS is certified under the Privacy Shield Agreement and thus offers a guarantee to comply with European data protection law: https://www.privacyshield.gov/participant?id=a2zt0000000TRkEAAW&status=Active.

To use the DISQUS comment function, users can log in via their own DISQUS user account or an existing social media account (e.g. OpenID, Facebook, Twitter or Google). DISQUS obtains the logon data from the platforms. It is also possible to use the DISQUS comment function as a guest, without creating or using user accounts at DISQUS or one of the specified social media providers.

DESIGNLOVR would like to point out that we only embed DISQUS with its functions in our website, whereby we can influence the comments of the user(s). In this procedure, the user enters into a direct contractual relationship with DISQUS, within the framework of which DISQUS processes the comments of the user and is a contact person for any deletion of personal data. DESIGNLOVR also points out to its user that he/she can assume that DISQUS stores not only the comment content but also the IP address and the time of the comment and stores cookies on the respective device and uses them to display advertising. 5. Newsletter (Use Of Mailchimp)

The DESIGNLOVR newsletter is sent via MailChimp, a newsletter distribution platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

Both the e-mail address of the user, as well as their further data described in the context of these notes, are stored on the servers of MailChimp in the USA. MailChimp uses this information to send and evaluate the newsletter on behalf of DESIGNLOVR. Furthermore, MailChimp can use this data according to its own information to optimize or improve its own services, e.g. to technically optimize the sending and presentation of the newsletter or for economic purposes, in order to determine from which countries the recipients come. However, MailChimp does not use DESIGNLOVR's data to write to or pass them on to third parties.

DESIGNLOVR relies on the reliability and IT and data security of MailChimp. MailChimp is certified under the US-EU data protection agreement “Privacy Shield” and thus commits itself to comply with EU data protection regulations. Furthermore, DESIGNLOVR has concluded a data processing agreement with MailChimp. This is a contract in which MailChimp undertakes to protect the user's data, to process it on our behalf in accordance with the user's data protection regulations and in particular not to pass it on to third parties. Contents of the newsletter

DESIGNLOVR sends newsletters, e-mails and other electronic notifications containing advertising information (hereinafter “newsletters”) only with the consent of the user or a legal permission. If the contents of a newsletter are specifically described within the scope of registration, they are decisive for the consent of the user. Furthermore, the DESIGNLOVR newsletter contains information about the digital economy and all its branches (this may include references to articles, advertisements, whitepapers or online presences).

Double-Opt-In and logging

The registration for the DESIGNLOVR newsletter takes place in a so-called double opt-in procedure. This means that after registration the user will receive an e-mail asking him/her to confirm his/her registration. This confirmation is necessary so that nobody can log in with other e-mail addresses. Subscriptions to the DESIGNLOVR newsletter are logged in order to verify the registration process according to legal requirements. This includes the storage of the login and confirmation time, as well as the IP address. The user changes of the data stored in MailChimp are also logged.

To subscribe to the DESIGNLOVR newsletter, it is sufficient for the user to enter his/her e-mail address.

Statistical surveys and analyses

The DESIGNLOVR newsletter contains a so-called “web-beacon”, i.e. a pixel-sized file which is retrieved from the MailChimp server when the newsletter is opened. Within the scope of this retrieval, technical information, such as information about the browser and the user's system, as well as his/her IP address and time of retrieval are initially collected. This information is used to technically improve the services based on the technical data or the target groups and their reading behaviour based on their retrieval locations (which can be determined using the IP address) or access times.

The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to the individual recipients. However, it is neither DESIGNLOVR's nor MailChimp's intention to observe individual users. The evaluations serve much more to recognize the reading habits of the user and to adapt the contents of the DESIGNLOVR newsletter to them or to send different contents according to the interests of the user.

Online access and data management

There are cases where DESIGNLOVR directs the recipient to the MailChimp website. For example, the DESIGNLOVR newsletter contains a link with which the recipient can call up the old newsletter online (e.g. in case of display problems in the e-mail program). Furthermore, newsletter recipients can subsequently correct their data, e.g. their e-mail address. Likewise, the privacy policy of MailChimp is only available on their site.

In this context DESIGNLOVR points out that cookies are used on the website of MailChimp and thus personal data are processed by MailChimp, its partners and service providers (e.g. Google Analytics). DESIGNLOVR has no influence on this data collection. Further information can be found in the privacy policy of MailChimp. DESIGNLOVR also points out the possibilities to object to the collection of data for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/ (for the European area).

Cancellation/Revocation

The user can cancel the receipt of the DESIGNLOVR newsletter at any time, i.e. revoke his or her consent. At the same time the consents to its dispatch via MailChimp and the statistical analyses expire. A separate cancellation of the dispatch via MailChimp or the statistical evaluation is unfortunately not possible. A link to cancel the newsletter can be found at the end of each newsletter.

Legal bases General Data Protection Regulation

In accordance with the provisions of the General Data Protection Regulation (GDPR), DESIGNLOVR informs that consents to the dispatch of e-mail addresses are given on the basis of Art. 6 para. 1 lit. a, 7 GDPR and § 7 para. 2 no. 3 and para. 3 UWG. The use of the shipping service provider MailChimp, carrying out statistical surveys and analyses as well as logging of the registration procedure, are based on the legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR. DESIGNLOVR is interested in the use of a user-friendly and secure newsletter system that serves both business interests and the expectations of the user.

DESIGNLOVR points out that the user can object to the future processing of his/her personal data at any time in accordance with the legal provisions of Art. 21 GDPR. The objection may be lodged in particular against processing for direct marketing purposes.

6. Social Media

On the DESIGNLOVR website so-called “Sharing Buttons” of social networks such as Facebook, Twitter and Co. were integrated according to the “Shareiff method”.

A social network is an Internet-based social meeting place, an online community that enables the user to communicate with other users and interact in virtual space. A social network can serve as a platform for the exchange of opinions and experiences or enables the Internet community to provide personal or company-related information. In general, a social network enables its users to create private profiles, upload photos and network via friendship requests.

In contrast to the traditional integration of social media plugins, which led to every user being immediately recorded by the social networks when visiting a website and, if necessary, the IP address and further browser behaviour being logged, DESIGNLOVR only uses shared buttons according to the "Shareiff method" on this website. This method ensures that no unconscious data transmission takes place between the social networks and the user.

If the user clicks on a share button, a direct connection (in the form of a new window) is established with the respective network. 7. Analysis Tools (Use of Google Analytics)

Google Analytics (with anonymisation function) is integrated on the DESIGNLOVR website. Google Analytics is a web analytics service. Web analysis is the collection, collection and evaluation of data about the behaviour of users of websites.

A web analysis service collects, among other things, data on the website from which a user came to a website (so-called referrer), which subpages of the website were accessed or how often and for how long a subpage was viewed. The purpose of the Google Analytics component is to analyse the flow of visitors to the DESIGNLOVR website. Google uses the data and information obtained to evaluate the use of this website in order to compile online reports for DESIGNLOVR which show the activities on these websites and to provide other services in connection with the use of this website.

Google Analytics places a cookie on the information technology system of the affected user. What cookies are has already been explained above. 8. Embeds, Plugins And Tools

Google Fonts

The DESIGNLOVR website integrates external fonts from Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, https://www.google.com/fonts (“Google Fonts”). Google Tag Manager

The Google Tag Manager is a solution with which DESIGNLOVR can manage so-called “website tags” via an interface (and thus integrate Google Analytics and other Google marketing services into my website, for example). The tag manager itself (which implements the tags) does not process any personal data. Integration of YouTube videos

The DESIGNLOVR website includes videos from the YouTube platform of third-party provider Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Integration of Instagram content

The contents of the Instagram Inc. platform offered by Instagram Inc. 1601 Willow Road, Menlo Park, CA, 94025, USA are incorporated into the DESIGNLOVR website. The tracking cookie does not store any personal data. Only the identification number of the affiliate, i.e. the partner referring potential customers, as well as the order number of the user(s) on a website and the advertising material clicked on are stored. The purpose of storing this data is to process commission payments between a merchant and the affiliate, which are processed via the affiliate network.
